M4 Served as Local Co-Counsel on Amicus Brief Submitted in Support of the State of Hawaii and Ismail Elshikh’s Challenge to the President’s Executive Order

David J. Minkin and Lisa W. Cataldo served as local co-counsel on the amicus brief of the Roderick & Solange MacArthur Justice Center filed in support of the State of Hawaii and Ismail Elshikh’s challenge to the President’s Executive Order. The federal district court cited the Center’s amicus brief in its Order Granting Motion for Temporary Restraining Order.

Jesse Smith Selected As One Of Twelve Participants To First Inaugural Federal Trial Academy

Jesse Smith was selected as one of twelve participants to the first inaugural Federal Trial Academy, which was sponsored by the Judges and staff of the United States District Court, District of Hawaiʻi and the Hawaiʻi Chapter of the Federal Bar Association. The program included two days of seminars presented by the federal judges and the top trial lawyers in the State, including M4’s own William C. McCorriston, who taught a seminar on cross-examination of adverse witnesses during trial. The program concluded with the twelve participants preparing and delivering opening and closing statements and examining witnesses in front of sitting federal district court Judges and a jury of their peers, including the federal Judges themselves, their law clerks, and members of the Federal Bar Association.

US District Court for the District of Hawaii Selects Jordon J. Kimura As Lawyer Delegate to Judicial Committee

The U.S. District Court for the District of Hawaii has selected Jordon J. Kimura to serve a three-year term as a lawyer delegate to its United States District Court Judicial Conference. The federal Court convenes the annual conference to promote the better administration of justice in Hawaii. Mr. Kimura’s selection as a delegate means that the judges of the Court voted to extend this invitation to him among all attorneys who have recently appeared before the Court. His appointment starts with the next district conference in April.

M4 Welcomes Kelsey S. Yamaguchi to the Firm

M4 is pleased to announce the addition of Kelsey S. Yamaguchi as an associate in the Firm’s transactional section. Mrs. Yamaguchi graduated summa cum laude from the William S. Richardson School of Law in 2015. At Richardson, she served as co-managing editor of the University of Hawaii Law Review, and won Second Place Best Team with her partner Jordan K. Inafuku at the 2014 Native American Moot Court competition. Prior to joining the firm as an associate, Mrs. Yamaguchi worked at the Hawaii Supreme Court as a law clerk for the Honorable Michael D. Wilson.

McCorriston Announces New Partners, Bennett J. Chin and Jordon J. Kimura

McCorriston is pleased to announce two new partners to the firm, Bennett J. Chin and Jordon J. Kimura.

Since he joined the firm in 2014, Mr. Chin has served—and will continue to serve—as the Director of McCorriston’s Design Professional Defense and Counseling Group, where he primarily represents and counsels architects and engineers. Mr. Chin will continue to bring years of experience in all aspects of construction litigation to the Firm. He has represented clients in a wide range of projects including shopping centers, airports, municipal works, transportation projects, residential projects, hospital projects, commercial high-rises, restaurants and government buildings. He has given seminars on loss prevention and risk management and has lectured for numerous organizations, including AIA, ACEC, ASID, University of Hawaii School of Architecture, College of Environmental Design, University of California, Berkeley, Department of Architecture, Pacific Building Trade Expo, and Lorman Education Services.

McCorriston first hired Mr. Kimura in 2007 as a summer associate and as an associate in 2009 after he graduated summa cum laude from the Richardson School of Law at the University of Hawai’i. He has since established himself as a rising star in the local Hawai’i legal community in civil, commercial, and probate litigation as well as in estate planning, with key litigation accomplishments including dismissal of a construction lawsuit for a large bridge defect case on the basis of the economic loss rule and dismissal of claims against a health care plan provider for purported wrongdoing with respect to health care coverage. As a member of the Firm’s Trusts, Estate Planning, and Wealth Management Practice Group, Mr. Kimura brings his litigation experience and expertise to effectively counsel clients on asset protection planning while also planning for the surviving spouse and helping to ensure a continuing legacy.

M4 Welcomes Kurt W. Klein and Jordan K. Inafuku

M4 is pleased to announce the addition of Kurt W. Klein and Jordan K. Inafuku as associates to the Firm's litigation section. Both lawyers are recent graduates of the William S. Richardson School of Law, where they excelled academically and in their extracurricular activities.

Mr. Inafuku graduated summa cum laude from Richardson, served as co-managing editor of the University of Hawaii Law Review, and won First Place Best Oral Advocate at the national 2015 Native American Moot Court competition. Prior to joining the firm as an associate, Mr. Inafuku worked at M4 as a summer associate in 2013 and 2014.

Mr. Klein participated on the Richardson Native American Moot Court team all three years of law school and was selected as team captain in 2013. In 2014, Mr. Klein was awarded the John S. Edmunds Award for Civility and Vigorous Advocacy, recognizing him for his strong oral advocacy skills and honorable civility. Prior to joining the Firm, Mr. Klein worked as intern for the United States Attorney for the District of Hawaii, a legal research intern for the Office of Hawaiian Affairs, and an extern with the Honorable Associate Justice Paula A. Nakayama of the Hawaii Supreme Court.

M4 Wins "Gold Coast" Public Access Case

June 30, 2015. In the significant public access case of Gold Coast v. State of Hawaii, the Intermediate Court of Appeals affirmed the Circuit Court’s judgment that the Waikiki Seawall along the "Gold Coast" belongs to the State of Hawaii, together with the implied duty to repair and maintain the seawall at state expense. After winning at trial, M4 attorneys Robert G. Klein, Randall K. Schmitt, Jordon J. Kimura, and Troy J. Andrade have now obtained a total victory before the Intermediate Court of Appeals. This ruling affirms that the State (and not the private landowners abutting the Seawall) have the obligation to repair and maintain the seawall together with legal liability arising out of the seawall's disrepair.

The victory is bolstered by the appellate court’s further holding that the lower court should have awarded the Gold Coast its attorneys’ fees and costs because the State waived its sovereign immunity when it countersued Gold Coast. The case will be remanded back to circuit court for a determination as to Gold Coast’s attorneys’ fees and costs.

M4 warmly welcomes Marguerite S. Nozaki as associate to the Firm.

Ms. Nozaki brings over eight years of litigation experience to the Firm, having served as an associate at two other Honolulu law firms and most recently as Deputy Corporation Counsel to the City and County of Honolulu. As Corporation Counsel, Ms. Nozaki represented various departments of the County, including the Honolulu Police Department, focusing on civil rights litigation and employment law. In addition to these areas, Ms. Nozaki's experience covers a wide range of practices, including insurance defense, workers' compensation, complex civil and commercial litigation, trust litigation, and medical malpractice. She is active in the legal community, serving as a director of the Hawaii State Bar Association's Young Lawyers Division and the co-chairperson of a number of committees.

Catherine Taschner appointed to the Access to Justice Commission's Committee on Increasing Pro Bono Services

M4 associate Catherine Taschner was appointed a member of the Access to Justice Commission's Committee on Increasing Pro Bono Services. By studying best practices in other jurisdictions for increasing the level of pro bono services by lawyers and others who may assist in overcoming barriers to access to justice, the Committee hopes to foster a culture of commitment to high-level pro bono service.

M4 Associates Catherine Taschner Volunteer Services for Law Week

On May 5, 2014, M4 Associates Catherine Taschner volunteered to staff a free legal information clinic in Nanakuli for Law Week, an event run by the Young Lawyers Division of the HSBA. Community members were encouraged to seek legal information to better understand the legal issues they are facing. Questions ranged from adoption to Hawaiian sovereignty.

Hawai'i Intermediate Court of Appeals Upholds Judgment in Favor of M4's Client The Kahala Hotel & Resort

M4 attorneys David Minkin and Becky Chestnut obtained a significant win in the Hawai'i Intermediate Court of Appeals on behalf of The Kahala Hotel & Resort. The opinion affirmed judgment in favor of The Kahala Hotel & Resort reversing the trial court's denial of The Kahala Hotel & Resort's Motion for Partial Summary Judgment as to liability and holding moot the reversal of the jury verdict because without any liability, the case should have never reached the jury.

Hawai'i Supreme Court Upholds M4's Successful Appeal on Behalf of Kauai Planning Commission

M4 attorneys David Minkin, Becky Chestnut obtained a significant win in the Hawai'i Supreme Court on behalf of the Planning Commission of the County of Kaua'i. The Supreme Court's historic published opinion affirmed the Intermediate Court of Appeals' judgment in favor of the Planning Commission, and further clarified the duties imposed by the public trust doctrine.

M4 to Represent the County of Kauai - February 2014

M4's team, headed by David Minkin, Jesse Smith and Troy Andrade, was selected to represent the County of Kauai in the Ordinance 960 lawsuit filed by four biotech seed companies in federal court. As reported by The Garden Island: County Councilman Gary Hooser, who co-introduced the bill, said he was pleased the county settled on such a "high-powered, first-class" law firm - one he added has represented the county well in the past. "We have every confidence that this firm will appropriately represent the county's interests in this matter," Kauai Mayor Bernard P. Carvalho Jr. said in a statement. Councilman Tim Bynum, also a co-introducer of the controversial legislation, expressed similar sentiments as Hooser about the McCorriston firm. "It's a good firm. They're very robust. They have the tools," he said. Hooser noted, "The depth, strength and experience of the McCorriston bench combined with the subject matter, expertise and the experience of Earthjustice (and) the Center for Food Safety translates to Kauai having two top notch legal teams working on the community's behalf."

M4 Obtains Patent and Trademark Win - February 2014

KonaRed has agreed to pay fees in the form of stock to M4 client VDF FutureCeuticals for patent and trademark rights as the result of a lawsuit filed by M4 attorneys Robert G. Klein and Jordon J. Kimura. KonaRed is also required to purchase its raw materials from VDF beginning in 2017, according to the settlement. The lawsuit alleged that KonaRed infringed on three patents held by VDF and also violated VDF's trademark for "Coffeeberry". KonaRed's attempt to invalidate VDF's patents through the U. S. Trademark and Patent Office failed, leading to the settlement.

M4 Welcomes Courtney Sue-Ako and Bennett Chin to the Firm

M4 is pleased to welcome Courtney Sue-Ako as an Associate and Bennett Chin as Of Counsel to the Firm.

Courtney Sue-Ako graduated magna cum laude from the University of Washington with an Honors degree in English, and is a member of the Phi Beta Kappa Society. At the University of Hawai'i, William S. Richardson School of Law, she was a member of the Intellectual Property Moot Court Team and a Tech Editor for the University of Hawai'i Law Review. She also served as Vice-Magister on the Phi Delta Phi Richardson Inn board, and was a research assistant to Professor Danielle Conway. Ms. Sue-Ako is a member of the Hawai'i Women Lawyers and the Hawai'i State Bar Association's Intellectual Property and Technology Section. Previously Courtney joined the Firm as a contract attorney in December 2012 and is now an associate with the Firm's litigation department specializing in complex commercial litigation.

Prior to joining the Firm, Bennett Chin was an attorney at the Law Offices of Frank K. Goto, Jr. where he represented and counseled Design Professionals in all matters, including construction litigation, contract negotiation and collection matters. He has represented clients in a wide range of projects including shopping centers, airports, municipal works, transportation projects, residential projects, hospital projects, commercial high-rises, restaurants and government buildings. M4 Wins Landmark Easement Case against State - December 2013

M4 partners Robert G. Klein and Randall K. Schmitt won a significant victory in the Circuit Court of the First Circuit (Honolulu) for firm client the Gold Coast Neighborhood Association, which consists of many of the condominiums and co-ops fronting the Waikiki Seawall. The Court ruled that the State owned the Seawall and the property under it by surrender and/or has an easement over the Seawall for public access. This ruling means that the State, and not the private landowners abutting the Seawall, have the obligation to repair and maintain the Seawall together with legal liability arising out of the Seawall's disrepair.

Hawaii Supreme Court Victory for M4 Client - December 2013

The Office of Hawaiian Affairs, represented by M4 lawyers Robert G. Klein and Becky Chestnut, won a significant victory in the Hawai'i Supreme Court, which decided that revenues derived from the ceded lands trust created under the federal Admissions Act could be used by the Trustees of OHA in their discretion for the benefit of all Hawaiians regardless of blood quantum. This case follows on an earlier 9th Circuit Court ruling that upheld the Trustees use of ceded lands revenues under the federal law.

M4 Associates Volunteer for Junior Judges Day

October 2013. M4 associates Cat Taschner, Jesse Smith and Courtney Sue-Ako visited Ma'ili Elementary School in Waianae to participate in the HSBA Young Lawyers Division Junior Judges Program. Each attorney spoke to a class of sixth graders about the ethical and legal ramifications of commonly faced issues such as cheating, teasing, bullying, stealing, and property destruction. After the lesson, the M4 lawyers joined the students for lunch and spoke about their experiences both in school and as attorneys.

Troy J. H. Andrade graduated from the University of Hawaii at Manoa, Richardson School of Law in 2011, where he served as managing editor for the University of Hawaii Law Review. Troy worked as a research assistant to Professor Eric K. Yamamoto, and authored an award-winning article. He comes to M4 after clerking for the Honorable Mark E. Recktenwald, Chief Justice of the Hawaii Supreme Court. He currently volunteers as a member of the Hawaii State Bar Association's Civic Education Committee and as a Director of the Friends of the Judiciary History Center.

M4 Announces its 2013-14 Scholarship Winners

M4 is pleased to announce this year's recipients of the McCorriston Miller Mukai MacKinnon Scholarship Fund: Mary Evans, Jessica Gima, Ewan Rayner, and Kevin White. Each year M4 awards scholarships to a select group of students who demonstrate superior academic ability in M4's two primary areas of practice: real property and litigation. Catherine Taschner Honored for Her Excellence in Pro Bono Work

Klein to assist with its legislative lobbying efforts and successful passage of the measure.

M4, As Post-Trial Counsel, Overturns $2.144 Million Jury Verdict

M4 attorneys Jesse Smith, Jonathan Steiner, and David Minkin sought a new trial for Bubba Gump Shrimp Company, Inc. ("Bubba Gump"). At the trial, the jury awarded plaintiff $2.144 million in damages after determining that Bubba Gump (then represented by separate counsel) was negligent in a slip and fall at its Mai Tai Bar in Ala Moana Center. Because of conflicting jury instructions and improper comments by Plaintiff's counsel, the Court set aside the verdict and ordered a new trial.

M4 Successfully Appeals Adverse Ruling for County of Kauai.

M4 attorneys David Minkin, Becky Chestnut successfully represented the Planning Commission of the County of Kauai in appealing a circuit court's decision that declared a Use Permit and a Class IV Zoning Permit automatically approved and ordered the Planning Commission to grant a Special Permit without further deliberation. In a published opinion, the Intermediate Court of Appeals vacated the circuit court's final judgment and provided much-needed clarification of the Planning Commission's public trust duties.

M4 Wins Significant Destination Club Appeal.

The Intermediate Court of Appeals recently ruled in favor of M4 client Exclusive Resorts, which owns and operates a high end Destination Club at Pauoa Beach on the Big Island of Hawai'i, that the Club was not subject to state regulation as a timeshare business. This groundbreaking decision, obtained by a team of M4 lawyers led by Robert G. Klein and John Seibert, is the first to distinguish timeshare operations from destination clubs, and bodes well for other destination clubs seeking to do business in Hawai'i.

Donald Wong Presents Continuing Education Seminar.

In February, M4 partner Donald Wong provided required continuing education training to Morgan Stanley investment advisors. Mr. Wong has been licensed by the State of Hawaii Insurance Division as a course provider for Insurance CE Credits (Life and Property/Casualty) for the past 10 years, and he has provided seminars to insurance producers on a regular basis during that time. Mr. Wong has previously presented to New York life agents, UBS advisors, Marsh Mac employees, and other insurance and brokerage groups. M4 Welcomes Back Keith Suzuka.

M4 is thrilled to welcome back Keith Kiyoshi Suzuka as a partner in the firm's real estate department. In 1990, the firm - then known as McCorriston Miho & Miller - gave Keith the opportunity to work for the Tokyo law firm of Nagashima & Ohno. In 1992, Keith returned to M4 and became a partner in the firm's real estate department. Keith maintained his real estate practice with M4 for the next seven years, before returning to Tokyo in 1999. Following a short stint at White & Case's Tokyo office, Keith returned to Nagashima Ohno & Tsunematsu (fka Nagashima & Ohno), which had grown to become one of Japan's "Big Four" law firms, with roughly 330 Japanese attorneys and 10 foreign attorneys, where he headed the firm's staff of foreign lawyers and legal editors for the next 13 years. Upon returning to M4, Keith's practice will focus on real estate, corporate and business law matters and assisting clients (both domestic and foreign) with their cross-border legal affairs. M4's Procurement Team Wins Major Rail Appeal.

M4's Procurement Team of David Minkin obtained a critical victory before the Hawaii Intermediate Court of Appeals on behalf of their client, Ansaldo Honolulu JV, the contract awardee of the $1.4B Core Systems contract for the Honolulu Rail Transit Project. Ruling on a secondary administrative appeal, the ICA affirmed the summary judgment award that M4 obtained at the administrative hearing level in one of Hawaii's largest ever bid protests. Catherine A. Taschner graduated from the University of Hawai'i at Manoa, Richardson School of Law in 2011, where she earned a Pacific Asian Legal Studies certificate and was a member of the Intellectual Property Moot Court Team. Catherine comes to M4 after completing a one year clerkship for the Honorable Lawrence M. Reifurth at the Intermediate Court of Appeals for the State of Hawai'i. She is the Co-Founder and Vice President of the Business Law Corps, a non-profit organization that provides small businesses and entrepreneurs of limited means with access to the legal system. M4 Obtains Dismissal of Anti-Rail Lawsuit.

M4's Procurement Team obtained judgment on the pleadings in favor of its client, Ansaldo Honolulu JV, in a lawsuit filed by Honolulu resident Paul Berry. Mr. Berry's well-publicized Complaint alleged various statutory violations against Ansaldo and the State of Hawaii arising out of the underlying rail contract. M4's team of David Minkin immediately moved for judgment on the pleadings as to all of Berry's claims, and the Circuit Court granted M4's motion in its entirety.

Office of Hawiian Affairs Receives $200M Land Settlement.

M4 attorneys Robert G. Klein, Randall Sakumoto, Peter Hamasaki and Joel Kam were instrumental in advising the Office of Hawaiian Affairs ("OHA") during the due diligence phase of the land settlement that passed the State Legislature and was signed into law by Governor Neil Abercrombie on April 11, 2012. The legislation provides for the transfer of 30 acres of prime oceanfront land at Kakaako Makai to OHA in settlement of a decades-long dispute over revenues due OHA for the state's use of lands ceded to the State of Hawai'i at statehood in 1959. Mr. Klein was singled out by OHA Chair Colette Machado and Governor Abercrombie for his work on the settlement.

M4 Procurement Team Scores Another Big Victory

M4's Procurement Team successfully represented CVS Caremark in defending its recent award of the State Employer-Union Health Benefits Trust Fund's Pharmacy Beneficts Management Services contract. The team, led by David Minkin and Jesse Smith, CVS Caremark prevailed in four protests and subsequent administrative appeals filed by a CVS competitor, allowing the EUTF to transition its pharmacy benefits services to CVS Caremark over the coming months.

M4 Represents Client in Successful Challenge to Land Use Reversion

M4 attorneys Peter J. Hamasaki, on behalf of their client, DW Aina Le'a, successfully appealed a decision of the State Land Use Commission that sought to revoke the long-standing urban land use classification of The Villages of Aina Le'a on the Island of Hawaii. Judge Elizabeth Strance of the Third Circuit ruled in favor of DW Aina Le'a and its co-appellant, finding that the Land Use Commission had improperly attempted to revert the land use classification of the property. The decision clears the way for the development of The Villages of Aina Le'a, which will provide for the residents of the Island of Hawaii thousands of new homes and hundreds of affordable housing units; new retail, commercial, medical, golf, and recreational facilities; increased regional infrastructure; and numerous construction and related jobs for Hawaii workers.

M4 successfully defends class action against the Kahala Hotel & Resort

The M4 trial team, headed by David J. Minkin, represented the Kahala Hotel & Resort in a class action lawsuit brought by former banquet customers. The lawsuit was based on a statute regarding disclosure of the distribution of service charges. The court, the Honorable Gary W.B. Chang presiding, held that the Kahala's service charge was not illegal or deceptive. After a jury trial, Judge Chang granted the Kahala's Renewed Motion for Judgment as a Matter of Law, agreeing that Plaintiffs failed to prove that they suffered economic or financial harm as a result of the Kahala's actions. The Court entered judgment in favor of the Kahala.

M4 Leads NCAA to Defense Verdict in Seattle Bowl Trial

Bill McCorriston, with co-counsel Greg Curtner of Miller Canfield, led the National Collegiate Athletic Association to a defense jury verdict in a Circuit Court trial this month.

The case, filed by Plaintiff Aloha Sports Inc. (ASI), began in 2004. The NCAA successfully defended ASI's claim in both Federal and State Court on antitrust, contract and unfair competition theories. ASI sought more than $2 million and punitive damages, but the jury ruled in favor of the NCAA and dismissed the remaining claim for tortious interference with a claimed deal to transfer the then existing Seattle Bowl. The NCAA may seek to recover significant costs and fees incurred during this multi-year legal battle. (2011.09.19)

M4 leads client to victory in State's largest ever procurement protest

M4 successfully represented Ansaldo Honolulu JV, the awardee of the Core Systems Design-Build-Operate-Maintain Contract for the Honolulu High-Capacity Transit Corridor Project (Honolulu Rail), in connection with appeals filed by the two losing bidders, Bombardier Transportation (Holdings) USA Inc. and Sumitomo Corporation of America.

In two separate administrative appeals initiated by Bombardier and Sumitomo, the M4 team, consisting of David J. Minkin, secured summary judgment against Bombardier and prevailed in an evidentiary hearing against Sumitomo, upholding the award of Honolulu's largest ever public works project to Ansaldo. M4 also prevailed in defending Ansaldo in a subsequent appeal filed by Bombardier in the First Circuit Court. Sumitomo did not file a further appeal. (2011.09.13)
