M4, As Post-Trial Counsel, Overturns $2.144 Million Jury Verdict M4 attorneys Jesse Smith, Jonathan Steiner, and David Minkin sought a new trial for Bubba Gump Shrimp Company, Inc. ("Bubba Gump"). At the trial, the jury awarded plaintiff $2.144 million in damages after determining that Bubba Gump (then represented by separate counsel) was negligent in a slip and fall at its Mai Tai Bar in Ala Moana Center. Because of conflicting jury instructions and improper comments by Plaintiff's counsel, the Court set aside the verdict and ordered a new trial.

M4 Successfully Appeals Adverse Ruling for County of Kauaʻi. M4 attorneys David Minkin, Becky Chestnut, and Dayna Kamimura-Ching successfully represented the Planning Commission of the County of Kauaʻi in appealing a circuit court’s decision that declared a Use Permit and a Class IV Zoning Permit automatically approved and ordered the Planning Commission to grant a Special Permit without further deliberation. In a published opinion, the Intermediate Court of Appeals vacated the circuit court’s final judgment and provided much-needed clarification of the Planning Commission’s public trust duties.

OFFICE OF HAWAIIAN AFFAIRS RECEIVES $200M LAND SETTLEMENT. M4 attorneys Robert G. Klein, Randall Sakumoto, Peter Hamasaki and Joel Kam were instrumental in advising the Office of Hawaiian Affairs ("OHA") during the due diligence phase of the land settlement that passed the State Legislature and was signed into law by Governor Neil Abercrombie on April 11, 2012. The legislation provides for the transfer of 30 acres of prime oceanfront land at Kakaako Makai to OHA in settlement of a decades-long dispute over revenues due OHA for the state's use of lands ceded to the State of Hawai'i at statehood in 1959. Mr. Klein was singled out by OHA Chair Colette Machado and Governor Abercrombie for his work on the settlement.

M4's Procurement Team successfully represented CVS Caremark in defending its recent award of the State Employer-Union Health Benefits Trust Fund's Pharmacy Benefits Management Services contract. M4 Represents Client in Successful Challenge to Land Use Reversion. M4 attorneys Peter J. Hamasaki and Dayna H. Kamimura-Ching, on behalf of their client, DW Aina Le'a, successfully appealed a decision of the State Land Use Commission that sought to revoke the long-standing urban land use classification of The Villages of Aina Le'a on the Island of Hawaii. Judge Elizabeth Strance of the Third Circuit ruled in favor of DW Aina Le'a and its co-appellant, finding that the Land Use Commission had improperly attempted to revert the land use classification of the property.
