Hawai'i Intermediate Court of Appeals Upholds Judgment in Favor of M4's Client The Kahala Hotel & Resort
M4 attorneys David Minkin, Dayna Kamimura-Ching and Becky Chestnut obtained a significant win in the Hawai'i Intermediate Court of Appeals on behalf of The Kahala Hotel & Resort. The opinion affirmed judgment in favor of The Kahala Hotel & Resort reversing the trial court's denial of The Kahala Hotel & Resort's Motion for Partial Summary Judgment as to liability and holding moot the reversal of the jury verdict because without any liability, the case should have never reached the jury.
Hawai'i Supreme Court Upholds M4's Successful Appeal on Behalf of Kauai Planning Commission
M4 attorneys David Minkin, Becky Chestnut, and Dayna Kamimura-Ching obtained a significant win in the Hawai'i Supreme Court on behalf of the Planning Commission of the County of Kaua'i. The Supreme Court’s historic published opinion affirmed the Intermediate Court of Appeals' judgment in favor of the Planning Commission, and further clarified the duties imposed by the public trust doctrine.
M4 to Represent the County of Kauai - February 2014
M4's team, headed by David Minkin, Jesse Smith and Troy Andrade, was selected to represent the County of Kauai in the Ordinance 960 lawsuit filed by four biotech seed companies in federal court.As reported by The Garden Island: County Councilman Gary Hooser, who co-introduced the bill, said he was pleased the county settled on such a "high-powered, first-class" law firm - one he added has represented the county well in the past.

Ms. Kamimura-Ching has practiced as an associate in M4’s Litigation section since October 2007. She received her juris doctor, magna cum laude, from the William S. Richardson School of Law at the University of Hawaii at Manoa in 2005 and her bachelors of arts, cum laude, from Claremont McKenna College in 2002.
M4 Obtains Patent and Trademark Win - February 2014
KonaRed has agreed to pay fees in the form of stock to M4 client VDF FutureCeuticals for patent and trademark rights as the result of a lawsuit filed by M4 attorneys Robert G. Klein and Jordon J. Kimura. KonaRed is also required to purchase its raw materials from VDF beginning in 2017, according to the settlement. The lawsuit alleged that KonaRed infringed on three patents held by VDF and also violated VDF’s trademark for “Coffeeberry”. KonaRed’s attempt to invalidate VDF’s patents through the U. S. Trademark and Patent Office failed, leading to the settlement.

Courtney Sue-Ako graduated magna cum laude from the University of Washington with an Honors degree in English, and is a member of the Phi Beta Kappa Society. At the University of Hawai'i, William S. Richardson School of Law, she was a member of the Intellectual Property Moot Court Team and a Tech Editor for the University of Hawai'i Law Review. She also served as Vice-Magister on the Phi Delta Phi Richardson Inn board, and was a research assistant to Professor Danielle Conway.
M4 Wins Landmark Easement Case against State - December 2013
M4 partners Robert G. Klein and Randall K. Schmitt won a significant victory in the Circuit Court of the First Circuit (Honolulu) for firm client the Gold Coast Neighborhood Association, which consists of many of the condominiums and co-ops fronting the Waikiki Seawall. The Court ruled that the State owned the Seawall and the property under it by surrender and/or has an easement over the Seawall for public access. This ruling means that the State, and not the private landowners abutting the Seawall, have the obligation to repair and maintain the Seawall together with legal liability arising out of the Seawall's disrepair.
Hawaii Supreme Court Victory for M4 Client - December 2013
The Office of Hawaiian Affairs, represented by M4 lawyers Robert G. Klein and Becky Chestnut, won a significant victory in the Hawai'i Supreme Court, which decided that revenues derived from the ceded lands trust created under the federal Admissions Act could be used by the Trustees of OHA in their discretion for the benefit of all Hawaiians regardless of blood quantum. This case follows on an earlier 9th Circuit Court ruling that upheld the Trustees use of ceded lands revenues under the federal law.

M4 Associates Volunteer for Junior Judges Day
October 2013. M4 associates Scot Matayoshi, Cat Taschner, Jesse Smith, David Day and Courtney Sue-Ako visited Ma'ili Elementary School in Waianae to participate in the HSBA Young Lawyers Division Junior Judges Program. Each attorney spoke to a class of sixth graders about the ethical and legal ramifications of commonly faced issues such as cheating, teasing, bullying, stealing, and property destruction. After the lesson, the M4 lawyers joined the students for lunch and spoke about their experiences both in school and as attorneys.

M4 client, the Hawai'i Association of Professional Employer's Organizations, a trade group, was instrumental in the passage of Act 174, signed by Governor Abercrombie on June 25, 2013. The new law provides for registration of PEOs with the Department of Labor and Industrial Relations and exempts them from certain taxes. HAPEO selected M4 attorney Robert G. Klein to assist with its legislative lobbying efforts and successful passage of the measure.
M4, As Post-Trial Counsel, Overturns $2.144 Million Jury Verdict M4 attorneys Jesse Smith, Jonathan Steiner, and David Minkin sought a new trial for Bubba Gump Shrimp Company, Inc. ("Bubba Gump"). At the trial, the jury awarded plaintiff $2.144 million in damages after determining that Bubba Gump (then represented by separate counsel) was negligent in a slip and fall at its Mai Tai Bar in Ala Moana Center. Because of conflicting jury instructions and improper comments by Plaintiff's counsel, the Court set aside the verdict and ordered a new trial.
M4 Successfully Appeals Adverse Ruling for County of Kauaʻi. M4 attorneys David Minkin, Becky Chestnut, and Dayna Kamimura-Ching successfully represented the Planning Commission of the County of Kauaʻi in appealing a circuit court's decision that declared a Use Permit and a Class IV Zoning Permit automatically approved and ordered the Planning Commission to grant a Special Permit without further deliberation. In a published opinion, the Intermediate Court of Appeals vacated the circuit court's final judgment and provided much-needed clarification of the Planning Commission's public trust duties.
M4 Wins Significant Destination Club Appeal. The Intermediate Court of Appeals recently ruled in favor of M4 client Exclusive Resorts, which owns and operates a high end Destination Club at Pauoa Beach on the Big Island of Hawai'i, that the Club was not subject to state regulation as a timeshare business.
Donald Wong Presents Continuing Education Seminar. In February, M4 partner Donald Wong provided required continuing education training to Morgan Stanley investment advisors.

M4 Obtains Dismissal of Anti-Rail Lawsuit. M4's Procurement Team obtained judgment on the pleadings in favor of its client, Ansaldo Honolulu JV, in a lawsuit filed by Honolulu resident Paul Berry.
OFFICE OF HAWAIIAN AFFAIRS RECEIVES $200M LAND SETTLEMENT. M4 attorneys Robert G. Klein, Randall Sakumoto, Peter Hamasaki and Joel Kam were instrumental in advising the Office of Hawaiian Affairs ("OHA") during the due diligence phase of the land settlement that passed the State Legislature and was signed into law by Governor Neil Abercrombie on April 11, 2012. The legislation provides for the transfer of 30 acres of prime oceanfront land at Kakaako Makai to OHA in settlement of a decades-long dispute over revenues due OHA for the state's use of lands ceded to the State of Hawai'i at statehood in 1959. Mr. Klein was singled out by OHA Chair Colette Machado and Governor Abercrombie for his work on the settlement.
M4 Selected by City to Review Rail Disputes. M4 is pleased to announce that its Construction and Government Contracts practice groups joined forces and were selected to review all construction claim disputes and to represent the City and County of Honolulu when such disputes arise in the process of developing the high speed rail project. Led by Senior Partner and former Supreme Court Associate Justice Robert Klein, the team includes construction litigators Randall Schmitt and Jordon Kimura, and procurement litigators David Minkin and Ken Mansfield. M4 Procurement Team Scores Another Big Victory. M4's Procurement Team successfully represented CVS Caremark in defending its recent award of the State Employer-Union Health Benefits Trust Fund's Pharmacy Benefits Management Services contract. Led by David Minkin, Ken Mansfield, Laura Lucas and Jesse Smith, CVS Caremark prevailed in four protests and subsequent administrative appeals filed by a CVS competitor, allowing the EUTF to transition its pharmacy benefits services to CVS Caremark over the coming months.

M4 Represents Client in Successful Challenge to Land Use Reversion. M4 attorneys Peter J. Hamasaki and Dayna H. Kamimura-Ching, on behalf of their client, DW Aina Le'a, successfully appealed a decision of the State Land Use Commission that sought to revoke the long-standing urban land use classification of The Villages of Aina Le'a on the Island of Hawaii. Judge Elizabeth Strance of the Third Circuit ruled in favor of DW Aina Le'a and its co-appellant, finding that the Land Use Commission had improperly attempted to revert the land use classification of the property.
